1. Acceptance of Terms

By accessing or using the finXPN platform, website, or API (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. No Financial Advice

finXPN is a financial analysis tool, not a financial advisor.

All data, forecasts, signals (including but not limited to "Bullish", "Bearish", "Strong Bullish", "Strong Bearish", "Neutral"), technical indicators, candlestick pattern analysis, ensemble model outputs, and deep learning predictions provided through the Service are for informational and educational purposes only.

Nothing on this platform constitutes:

• Investment advice or a recommendation to buy, sell, or hold any security
• An offer or solicitation to buy or sell any financial instrument
• A guarantee of future performance or returns
• Professional financial, legal, or tax advice

You should always consult with a qualified financial professional before making any investment decisions. finXPN does not take into account your personal financial situation, risk tolerance, or investment objectives.

3. Signal Interpretation

Signals generated by finXPN (e.g., "Strong Bullish", "Bullish", "Neutral", "Bearish", "Strong Bearish") represent statistical outputs from mathematical models. These labels indicate the directional tendency of the models' predictions and should be interpreted as follows:

• Bullish/Strong Bullish — Models indicate an upward statistical tendency
• Neutral — Models show no clear directional tendency
• Bearish/Strong Bearish — Models indicate a downward statistical tendency

These signals do not and should not be construed as instructions to execute trades.

4. Data Sources and Attribution

Market data used by finXPN is sourced from third-party providers, including Yahoo Finance. finXPN does not guarantee the accuracy, completeness, or timeliness of any data. Data may be delayed, incomplete, or contain errors.

Forecast models include 13 statistical ensemble models (BSTS, ADAM, SMA, CES, GUM, GARCH, XGBoost, RandomForest, ETS, Theta, TBATS, NNAR) and Amazon Chronos deep learning. Model accuracy varies by market conditions and is not guaranteed.

5. Risk Disclaimer

All investments carry risk. Past performance of any financial instrument, model forecast, or analysis does not guarantee future results. The value of investments can go down as well as up, and you may lose some or all of your invested capital.

Financial markets are inherently unpredictable. No model, algorithm, or analysis tool can accurately predict future prices with certainty. The ensemble models, deep learning systems, and technical analysis provided by finXPN are subject to significant uncertainty and error.

6. API Terms (B2B)

If you access finXPN through our API:

• You agree to include the finXPN disclaimer in any product or service that displays finXPN data to end users
• You must not present finXPN signals as financial advice or trading recommendations to your users
• You must clearly attribute data sources (finXPN, Yahoo Finance) in your application
• API keys are non-transferable and are for use by the registered account holder only
• You must comply with the rate limits and request quotas of your subscription plan
• Automated mass scraping, reselling raw data, or redistributing API responses without attribution is prohibited

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent rate limits, authentication, or other security measures
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or redistribute finXPN data without written permission
• Use the Service to provide investment advisory services without proper regulatory authorization
• Present finXPN data as your own proprietary analysis without attribution

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINXPN AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM:

• Your use of or reliance on any data, forecasts, or signals provided by the Service
• Any trading or investment decisions made based on information from the Service
• Financial losses incurred as a result of using the Service
• Interruptions, delays, errors, or inaccuracies in the data or Service
• Unauthorized access to your account or API keys

You acknowledge that you use the Service entirely at your own risk.

9. Subscriptions and Payments

finXPN is currently in beta and is provided free of charge. No subscription fees are being collected, no payment details are required, and no charges will be applied without prior notice.

The terms below describe how paid plans will operate if and when they are introduced. Subscription fees would be charged at the beginning of each billing period and would be non-refundable except where required by law. finXPN would give at least 30 days notice before introducing or modifying pricing.

API plans (Starter, Business, Enterprise) define monthly request quotas and rate limits. Exceeding these limits results in request throttling, not additional charges.

10. Modifications to Terms

finXPN reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated via the platform or email for API subscribers.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of the jurisdiction in which the Service operator is established.
